The Class Action Complaint alleges that the Raspberry Lemonade Tea sold by Total Life Changes caused Plaintiff to fail a drug test despite the company’s advertising.

ATLANTA, GA, June 18, 2021 /24-7PressRelease/ — On June 15, 2021, Ashley Miller, a Staff Sergeant in the Army, filed a class action against Total Life Changes, LLC (“TLC”) in the US District Court for the Southern District of Georgia alleging that the company falsely advertised its Raspberry Lemonade Tea as containing “0.0% THC.” She asserts claims under Georgia consumer protection statutes and common law on behalf of herself and a class of consumers that have been harmed by TLC’s alleged misrepresentations in Georgia.

TLC sells vitamins, weight loss supplements, teas, essential oils, and skin care products, some of which contain derivatives of cannabis, such as hemp. Although TLC disclosed detectable levels of THC in some of its products, Miller alleges, TLC marketed its Raspberry Lemonade Tea as containing “0.0% THC,” which is claimed was “lab-certified” and “100% authentic guaranteed.” Despite this promise, Plaintiff says she tested positive for THC after consuming the Tea, causing adverse personal and employment consequences. The Complaint requests damages, equitable relief, punitive damages, and attorneys’ fees and costs for Plaintiff and the proposed Class.

Chloe Raimey, one of the attorneys representing the consumers, stated, “TLC’s misrepresentations continue to harm consumers in Georgia and elsewhere who did not choose to consume a product containing the psychoactive ingredient THC. This lawsuit seeks to justice for consumers that have suffered damages due to TLC’s false statements in Georgia, as well as injunctive relief to protect consumers from future harm.”

Plaintiff is represented by Matthew Morgan, Anna Prakash, and Chloe Raimey of Nichols Kaster, PLLP; John F.
