A construction worker who developed and then died from mesothelioma after being exposed to asbestos has won a large confidential settlement against the Long Island Lighting Company
NEW YORK, NY, October 16, 2018 /24-7PressRelease/ — Nationally recognized New York law firm Belluck & Fox, LLP, has won a huge settlement against the Long Island Lighting Company, a wholly owned subsidiary of the Long Island Power Authority, on behalf of a construction worker who died from mesothelioma after being exposed to asbestos during the construction of the Shoreham Nuclear Power Plant.
Robert Northrup was hired by the engineering firm Stone & Webster in 1977 and was assigned to the Shoreham Nuclear Power Plant construction site. It was his first job after high school and he worked there for the next three years. During this time, he worked mostly as a junior construction assistant and was regularly exposed to large quantities of asbestos dust in the air.
The Long Island Lighting Company, then known as LILCO, was in charge of the construction and was responsible for providing a safe working environment for Mr. Northrup. There is no safe level of exposure to asbestos, so even though Mr. Northrup only worked on the site for three years and was only exposed as a bystander, this exposure led to his developing pleural mesothelioma in 2016. After battling the disease for more than a year, he died on December 12, 2017. He is survived by his wife Karen, their two children Kristina and Lindsay, and three grandchildren. The trial of Robert Northrup and Karen Northrup v. Air & Liquid Systems Corporation, et al. (Index No. 003780-2017) was heard before Honorable James C. Hudson in the Supreme Court of New York, County of Suffolk. The parties agreed to a settlement on October 31, 2017.
Bryan Belasky, a partner at Belluck & Fox, handled Mr. Northrup’s deposition.
“Robert Northrup and his family had the greatest years of his life stolen from them through the development of this insidious disease,” said Belluck & Fox partner Joseph Belluck. Mr. Belluck handled the settlement negotiation. “We are proud that we settled this case before Robert’s passing so he had peace of mind his family would be taken care of.”
Asbestos is a mineral that causes lung cancer and mesothelioma, aggressive and deadly forms of cancer.
At trial, Belluck & Fox presented evidence from a series of experts regarding the use of asbestos during the building construction process, the causation of Mr. Northrup’s mesothelioma, the state-of-the-art evidence relating to the dangers of asbestos and testimony about the cancer’s impact on him and his family.
“You don’t get this kind of result for your client without a total team effort. It starts with the deposition, strategic planning, motions and appeals. No firm has the team of lawyers that Belluck & Fox has,” said Mr. Belluck. “When a case is worked up properly, it is easy to convince a jury that our clients should be compensated.”
